Divorce may be more likely to start the new year

On Behalf of | Jan 5, 2026 | Divorce

Divorce happens throughout the year, and when many people look at divorce rates, they are referring to annual statistics. These numbers are averaged out over a 12-month period.

However, studies do find that these statistics are not necessarily consistent. Some months have higher divorce odds than others. January is one of those months, as there is typically a spike in divorce cases, especially in the first week. But why would divorce be more likely as the new year begins?

A fresh start

In some cases, couples view the new year as a chance for a fresh start. Ending the relationship they are already involved in may be a step they want to take to change their lives moving forward. The new year acts as a catalyst for this change.

Avoiding the holidays

Additionally, many couples consider divorce earlier in the year, but they do not want to move forward with the process during the Thanksgiving or Christmas holidays. They choose to wait and file for divorce when the new year begins.

The last straw

Finally, for some, Christmas is the last straw. They may hope that the holidays will help rekindle their relationship, or they may be forced to spend more time together. Either way, as they settle back into their routine in January, they decide that something needs to change.

The legal process

Do you believe that you and your spouse may be getting a divorce this year? If so, be sure you understand the legal process and all of your rights when it comes to property division, child custody and more.
