Holding Dog Owners Accountable

Under Massachusetts law, an owner or keeper of a dog who bites or attacks an individual is strictly liable for the injuries caused by the dog bite or attack, unless the victim was trespassing or was teasing, tormenting or abusing the dog. If the victim was under the age of 7, he is presumed to have not been trespassing, teasing, tormenting or abusing the dog. No matter the age of the victim, the dog owner/keeper will be liable even if the dog has no past history of biting or attacking others.

It is not necessary that the injuries be solely from dog bites in order for the owner/keeper of a dog to be liable for injuries caused by the dog. The statute merely states that the dog owner/keeper is liable for "any damage" done by the dog. Therefore, a dog owner/keeper would be liable to someone who is attacked by a dog and is injured due to being thrown down by the dog. This statute, along with other common law principles, could also find the dog owner/keeper responsible for injuries suffered by someone who falls down while running away from the dog or who is hit by a car while attempting to escape from the dog.
